SMS Privacy Policy

  1. Fidelity Bank ("we," "us," "our," or "FBOT") takes our customers' privacy seriously. This SMS Privacy Policy details how FBOT will use, disclose, and safeguard your information when you, as our customer, choose to participate in our SMS program ("Text Messaging"). Your use of Text Messaging is governed by, and subject to, this SMS Privacy Policy as well as FBOT's SMS Terms and Conditions (see below).
  2. When you opt-in to Text Messaging we may collect your phone number, carrier details, timing and content of messages, and any other information sent to FBOT.
  3. FBOT may use your information to contact you and to operate, develop and improve FBOT's Text Messaging services. You may also receive text messages when you apply for, or attempt to use, an FBOT product or service, as applicable, or when you contact FBOT.
  4. FBOT will never trade or otherwise sell your personal information such as phone numbers and Text Messaging consent to third parties. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes except as described in FBOT's general Privacy Statement. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. FBOT may share your information with service providers who assist FBOT in providing our Text Messaging services, and law enforcement or regulatory agencies if required by law.
  5. FBOT implements appropriate technical and organizational measures to protect your information from unauthorized access and use.
  6. FBOT may update this SMS Privacy Policy from time to time. FBOT will notify you of any changes by posting the new policy on FBOT's website and updating the effective date.

SMS Terms and Conditions

  1. Please review these SMS Terms and Conditions carefully and contact Fidelity Bank ("we," "us," "our," or "FBOT") prior to enrolling if you have any questions or do not understand these SMS Terms and Conditions. By enrolling in our SMS program ("Text Messaging"), you agree to these SMS Terms and Conditions, and you also agree to FBOT's SMS Privacy Policy (see above).
  2. To opt out of Text Messaging, simply reply to FBOT's text message on your mobile device with the word STOP.
  3. Each time you use Text Messaging, you affirm your agreement to FBOT's SMS Terms and Conditions and to FBOT's SMS Privacy Policy. FBOT reserves the right to, and from time to time may, revise these SMS Terms and Conditions and/or its SMS Privacy Policy. FBOT will notify you of any changes by posting the new policy on FBOT's website and updating the effective date.
  4. When you provide information to FBOT, you agree to provide accurate, complete, and true information. You agree that FBOT may collect information from you including (but not limited to) your phone number, carrier details, timing and content of messages, and any other information sent to FBOT.
  5. FBOT may use this information to contact you and to operate, develop and improve FBOT's Text Messaging services. You may also receive text messages when you apply for, or attempt to use, an FBOT product or service, as applicable, or when you contact FBOT. FBOT's message frequency to you may vary, but if at any time you determine the frequency of text messages to be excessive, you may immediately opt out of the Text Messaging service. FBOT reserves the right at all times to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect FBOT's rights or property.
  6. Your wireless carrier and other service providers may also collect data from your Text Messaging usage, and their practices are governed by their own policies.
  7. By using Text Messaging, you represent that you are the owner or authorized user or subscriber of the phone number and wireless device that you are using to receive text messages from or on behalf of FBOT.
  8. FBOT WILL NEVER SEND YOU A TEXT MESSAGE ASKING YOU TO PROVIDE OR CONFIRM PERSONAL DETAILS OR CONFIDENTIAL INFORMATION, SUCH AS PASSWORDS, SOCIAL SECURITY NUMBERS, OR ACCOUNT NUMBERS. DO NOT REPLY TO ANY MESSAGE REQUESTING PERSONAL DETAILS OR CONFIDENTIAL INFORMATION. Please, immediately report any such message by contacting FBOT at +1 254-755-6555.
  9. Message and data rates may apply. Text Messaging is subject to applicable messaging and data fees from your wireless carrier. Please refer to your wireless plan details for more information. However, FBOT does not charge you a separate fee for your use of its Text Messaging service.
  10. You acknowledge and agree that your receipt of any Text Messaging may be delayed or prevented by factor(s) affecting your wireless service provider, internet service provider(s) and other factors outside of FBOT's control. Text Messaging is subject to many factors including availability of service with your network, compatibility of your network and device with FBOT's systems, and processing by your mobile device. Text Messaging services are provided on an "AS IS, AS AVAILABLE" basis. FBOT will not be liable for any delays or failures in your receipt of any Text Messaging. FBOT will not be required to resend any message even if the message was not received on your mobile device. In no event shall FBOT be liable for any claim arising from delayed, misdirected, or failed delivery of any information sent through the Text Messaging service.
  11. FBOT may suspend or terminate Text Messaging to you if FBOT has reason to believe you are in breach of current SMS Terms and Conditions. Text Messaging services are also subject to termination in the event your wireless service terminates or lapses, or in the event of your FBOT account closure or legal process. FBOT may also discontinue Text Messaging at any time, in its discretion, with no liability.
  12. Text Messaging services are provided only in the United States.
  13. You agree to indemnify, defend, and hold FBOT harmless from any third-party claims, liability, damages, or costs arising from (1) your use of the Text Messaging service, and (2) the provision of a phone number that is not your own.
  14. You agree to notify FBOT immediately of any changes to your mobile device. In case of unauthorized access to your mobile device or service, you agree to cancel enrollment associated with the device immediately.
